Recently while on holiday in England I visited a number of castle and towns.

At Sherbourne Castle I purchased a cat statue set (made of 2 cats, which "nested" against each other) - also in this range were frogs, cows, elephants, hedgehogs, monkeys.

I also saw them briefly with a friend at a garden centre - we were staying at Woodstock, near Oxford, at the garden centre was nearby - but I'm not sure which town. Has anyone seen these, and can someone point me in the right direction to find out more information about them - maybe a manufacturer's name?

I checked Ebay - but the problem is, I'm not sure what the correct name for these are. I have contacted Sherbourne Castle, and hopefully they might be able to help.

I posted on here, as I thought someone, a fellow cat lover, may have spotted them somewhere.

Mr Hay and Mr Corn are two neighbours who live in the rural village of Barley Field. Both are experiencing problems in respect of their land and decide to visit Mr Law the village solicitor. They seek advice on the following issues:

In March 2008 Mr Hay purchased Bramble Farm from Major Thorn. The farm was a registered freehold property when it was transferred to Mr Hay, and Mr Hay was entered as the registered proprietor with absolute title. Subsequently, the following maters have come to light:

(1)Rose, Major Thorn’s partner, has arrived at the property. She was visiting her daughter in New Orleans at the time of the sale, and knew nothing about it. She has documentary evidence that she contributed half the purchase price when Major Thorn acquired Bramble Farm, though she was never entered on the register as a proprietor.

(2)Mr Wood has produced a properly executed deed, dated 2005, whereby Major Thorn granted him a six-year lease of a cottage on the farm. Mr Wood has never actually lived in the cottage. The lease gave him the option to buy the freehold of the cottage should Major Thorn ever decide to sell.

(3)Mr Hay encounters another neighbour, Mr Plant ambling across the overgrown field to the rear of the outbuildings. When he confronts Mr Plant, he is informed that both Mr Plant and his predecessors have been using the field for many years as a short cut to the local pub and intend to continue with or without his permission. Mr Hay is furious as he has earmarked this part of the land to build a granny annexe for his ageing mother.

(4)On moving into the property, Mr Hay is furious to find that an ornamental bronze statue of an African elephant and its plinth have been removed from the garden. He is amazed that Major Thorn has managed to remove it as it was extremely heavy. A local villager informed him that Major Thorn had installed the elephant and other memorabilia in the garden in the late 1970’s when he returned from his travels to Africa. The elephant had caused quite a stir in the village because the Major had had to hire special lifting equipment to manoeuvre it.

You are Mr Law, the solicitor and it is your role to advise Mr Hay as to the factors that will determine which (if any) of the above matters will be binding upon him, and whether or not he can retrieve the elephant.

This is about overriding and minor interests in land formerly governed by the LPA 1925 but now covered by the 2002 Act.The obvious issue is which if any potential interest in the land can defeat a bone fide purchaser for value without notice of it.You could work through the table in the following link.http://www.kevinboone.com/lra.html

I am a bit rusty on the details but my thoughts for what they're worth are as follows ( can't guaranteee 100% technically correct but hope it will point you in the right direction)

(1) The property was 'transferred' to Mr.Hay.Can you assume that Hay was in fact a bona fide purchaser for value without notice.

(2) Rose made a contribution to the purchase price and prima facie had some interest in the land ( unless of course the contribution was an absolute gift.) It seems obvious that her name did not appear as proprietor on the title so that leaves her with an interest as either
(i) contributor - equitable interest ? If so what sort and was ut registerable and registered ?
(ii) partner of prior owner - was the property a Matrimonial home and her interest registerable as a Class F charge.EVen if it was did she register one ?
(iii) occupier (and if this is any sort of interest in the property did Hay have notice of it if she was in New Orleans ?

(3) Mr Wood's lease dated 2005 should be covered by the 2002 Act.It would have been an overriding interest had it been for 7 years or more but as it was not. Provided Mr.Hay had no notice of it , it is not binding on him.Mr Wood never actually lived in the cottage.It is therefore reasonable to assume that Mr.Hay could not have known Mr.Wood was in any way associated with it.However Mr.Wood may have sublet and had Mr.Wood visited the premises ( or asked the relevant question as a pre-contract enquiry) he might have been put on notice that the vendor was not in actual occupation.The option to purchase the freehold is an estate contract and is only binding if registered as a Class C charge.

(4) Mr.Plant is claiming an easement based on habitual use ( adverse possession ?).You need to decide if this adverse use can constitue either legal or an equitable easement and what consequences flow particulalry if it is not registered as either.

(5) This is a possibly more straightforward issue about whether the statue was personal removable property or a fixture so permanently annexed to the land that title to it passes on the transfer.Think about its weight and the amount of installation effort required both going in and coming out
